Terms and Conditions

1. Acceptance of Terms

By creating an account, downloading, installing, or using the applications or software provided by Exposio Technologies Inc. (hereinafter the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Service.

2. Intellectual Property of Software and Services

All software (including Exposio Darkroom and the mobile app), interfaces, algorithms, and underlying technologies provided by Exposio are the exclusive property of Exposio Technologies Inc. The provision of our services does not grant you any intellectual property rights to the Software, except for the limited, personal, and non-transferable right of use expressly granted by this agreement. It is strictly prohibited to sell, copy, lease, distribute, or reverse-engineer the software.

3. User Content Ownership and Granted Licenses

3.1. Client Ownership: You retain full copyright and intellectual property rights to all photographs and images you upload, process, or create using our services (hereinafter referred to as the "Content"). Exposio Technologies Inc. claims no ownership over your Content.

3.2. License Granted to Exposio: By using our services, you grant Exposio Technologies Inc. a worldwide, non-exclusive, and royalty-free license to use, copy, store, and process your Content for the following purposes:

• Processing and Subcontracting:

  To provide the requested service, which includes the right to securely transmit your Content to third-party service providers acting on our behalf.

• Technological Development:

  To analyze, develop, and improve our technologies, algorithms, and artificial intelligence systems.

• Quality Control:

  To allow our team to confidentially access your Content to perform reviews and ensure the quality control of our services.

4. Content Deletion Request

You have the right to request the deletion of your Content from our systems at any time. To do so, you must notify us in writing by submitting a formal request to our support team (support@exposiohdr.com). Upon receipt of your notice, Exposio Technologies Inc. will have a maximum period of thirty (30) days to process your request, correct the situation, and permanently delete the relevant photos from its active databases and training systems.

5. Account Creation and Management

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Exposio reserves the right to suspend or terminate your account in case of violation of these terms.

6. Payments and Billing

Certain services or features (such as HDR processing) may require payment. All purchases are final and non-refundable, unless otherwise required by law. Payments are processed by secure third-party providers (Apple, Google, PayPal, etc.).

7. Acceptable Use

You agree to use the Service only for lawful purposes. You are prohibited from uploading illegal or offensive content, or content that violates the intellectual property rights of any third party.

8. Limitation of Liability and Warranties

The Service is provided on an "as is" and "as available" basis. Exposio Technologies Inc. cannot be held responsible for any direct or indirect loss incurred by using this software. Such loss includes but is not limited to the loss of profits, data, money, availability, clients, and computer hardware.

9. Governing Law and Jurisdiction

These terms shall be governed and construed in accordance with the laws of the Province of Quebec and the applicable laws of Canada. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of the judicial district of Quebec City.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes by posting the new terms on our website or through the application.
